These SMS Terms & Conditions (“SMS Terms”) govern text messages sent by SportLynx, Inc. (“SportLynx,” “we,” “us,” or “our”) to users of the SportLynx platform. By providing your mobile phone number and opting in to receive text messages, you agree to these SMS Terms.

These SMS Terms supplement our general Terms of Service and Privacy Policy. In the event of a conflict between these SMS Terms and our general Terms of Service as they relate to text messaging, these SMS Terms control.

1. Program Description

SportLynx provides software and communication tools used by youth sports organizations, administrators, referees, coaches, participants, and family members. If you opt in, SportLynx may send SMS messages related to your account, your participation in a sports organization using the SportLynx platform, or operational activity initiated through the platform.

SMS messages may include, by way of example:

referee assignments, confirmations, and updates

game schedule changes and reminders

weather cancellations and field closures

registration confirmations and reminders

payment confirmations and payment-related notifications

event reminders

account-related alerts

other operational or transactional notifications related to an organization with which you are registered or associated through SportLynx

SportLynx does not use purchased lists or third-party marketing lists for these messages.

2. Opt-In

You will receive SMS messages only if you provide your mobile phone number and expressly consent to receive such messages. Consent may be collected through account registration, organization registration, notification settings, or another clear opt-in mechanism presented through the SportLynx platform or a participating organization’s workflow.

By opting in, you authorize SportLynx to send text messages to the mobile number you provided using automated technology where applicable.

Your consent applies only to communications permitted by your relationship with SportLynx and/or the participating organization and subject to your selected notification settings.

3. Message Frequency

Message frequency varies. The number of messages you receive will depend on your account activity, role, organization participation, assignments, registrations, payment activity, and platform events.

Some users may receive only occasional transactional messages, while others, including referees, administrators, coaches, or active participants, may receive recurring operational notifications.

4. Message and Data Rates

Message and data rates may apply. Charges for text messages and data usage are determined by your mobile carrier and your mobile plan. SportLynx is not responsible for any messaging or wireless charges incurred by you.

5. Not a Condition of Purchase

Consent to receive SMS messages is not a condition of purchasing any goods or services from SportLynx.

6. Eligibility and Mobile Number Responsibility

By opting in, you represent that:

you are the authorized user or subscriber of the mobile number provided, or you have authority to consent for that number

the mobile number you provide is accurate and current

you will promptly update your account if your mobile number changes

If you change or deactivate your mobile number, you agree to update your SportLynx account before the number is reassigned or used by another person.

7. How to Opt Out

You may opt out of SMS messages at any time by replying STOP to any SportLynx text message.

After you send STOP, you may receive one final confirmation message confirming that you have been unsubscribed.

You may also be able to manage or disable certain SMS notifications within your SportLynx account settings or notification preferences. However, replying STOP is the primary and most reliable method for opting out of SMS delivery.

Opting out may prevent you from receiving important operational notifications, including assignment updates, schedule changes, cancellations, payment notifications, and other time-sensitive alerts.

9. Participating Organizations

SportLynx may send messages on behalf of participating youth sports organizations that use the SportLynx platform. In those cases, the content of the message may relate to that organization’s operations, events, registrations, scheduling, referee management, payments, or participant activity.

Although a message may relate to a specific organization, these SMS Terms govern the delivery of messages sent through the SportLynx platform.

10. Privacy

Your privacy is important to us. Our collection, use, and protection of personal information, including information related to SMS messaging, is described in our Privacy Policy:

SportLynx does not share or sell mobile phone numbers, SMS opt-in data, or SMS consent information with third parties or affiliates for their marketing or promotional purposes.

We may use service providers, including communications platform providers, solely as necessary to deliver text messages and support the SMS program.

11. Supported Carriers and Delivery

SMS services may not be available on all carriers or devices and may be affected by carrier limitations, device compatibility, network availability, or other factors outside of SportLynx’s control.

Carriers are not liable for delayed or undelivered messages.

SportLynx does not guarantee that every message will be delivered or delivered within a particular timeframe.

12. User Duties and Acceptable Use

You agree not to use the SportLynx SMS program in any unlawful, abusive, fraudulent, or unauthorized manner. You may not:

provide a phone number that is not your own or that you are not authorized to use

attempt to interfere with the operation of the SMS program

use the SMS program in violation of applicable law, carrier rules, or third-party rights

13. Changes to SMS Program or Terms

We may modify, suspend, or terminate the SMS program, or any part of it, at any time, with or without notice.

We may also update these SMS Terms from time to time. If we make material changes, we will update the “Last Updated” date above and may provide additional notice where appropriate. Your continued participation in the SMS program after such changes become effective constitutes your acceptance of the revised SMS Terms.

14. Disclaimer

The SMS program is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, SportLynx disclaims all warranties, express or implied, regarding the SMS program, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, SportLynx and its officers, directors, employees, agents, service providers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the SMS program, including delays, delivery failures, misdirected messages, device issues, carrier issues, or unauthorized access to your mobile device.

If applicable law does not allow certain limitations of liability, some of the above limitations may not apply to you.

16. Governing Terms

These SMS Terms are incorporated into and governed together with the SportLynx Terms of Service / User Agreement, except where these SMS Terms specifically address SMS messaging obligations.
